Italian Notary Acts for foreign buyers

Confidence in the closing

Whether buying a villa on Lake Como or an apartment in the city, property is a dream for many, but the legal reality of an Italian notary act (atto notarile) can quickly become a maze of complex terminology and strict bureaucratic requirements.

As the only native English translator and simultaneous interpreter at the Courthouse of Como and one of only 4 in all of Italy, I provide a bridge between the rigorous Italian legal system and the peace of mind for international home buyers.

Here is an overview of how I facilitate notary acts on Lake Como, ensuring your property purchase is seamless, transparent, and legally sound.

Vital Role: Italian notary law requires a translator

Under Italian law (legge notarile), if any party to a deed does not speak Italian, the act must be assisted by a translator. This is not just a courtesy; it is a requirement. If the notary does not speak English, or if the documents are not translated, the act could be considered void without translation and simultaneous interpreting.

What if the notary provides a translator?

If you purchase the property, you have the right to chose your notary. While the chosen notary may speak some English, your notary may simply have one of their office assistants translate for you and charge you their notary prices for translation.

Pro Tip: Ask your notary for a price estimate with a breakdown showing the extra costs of translation. If they say it is included in the basic price, ask what the price is if you provide your own translator. Often prices for foreigners are different than for local Italians. You can chose to have your own translator.

Why choose a native English speaking translation professional from the courthouse?

While many people are bilingual, a notary act requires a specialized legal vocabulary and knowledge. Being approved by the Italian Ministry of Justice and registered as an expert translator and interpreter at the Courthouse of Como (Tribunale di Como CTU-217) means I have been vetted for my professional competencies and ethics.

  • Impartiality: I act as a neutral party to ensure the “true will” of the buyer or participating English speaker.
  • Legal Validity: My signature provides the legal assurance that you have fully understood your obligations.
  • Local Expertise: Working in Como city and Lake Como, I am familiar with the local notary offices and the specific procedural preferences and norms of the region as well as the next steps.
  • Native English: As a native English speaker, I help save time and avoid confusion lost in translation.

Comprehensive Real Estate Translation and Interpreting Services

A successful closing begins long before the final day of the signing. I handle the translation of all essential documents, ensuring that the English version is a faithful, legal mirror of the Italian original. I participate in the act to assure all aspects are crystal clear and questions answered.

Efficiency through simultaneous interpretation and native English

Most interpreters in legal settings use “consecutive” interpretation (the notary speaks, stops, and then the interpreter speaks). However, as a specialist in simultaneous interpretation, I can provide a much more fluid experience.

1. Save time

Traditional translation can double the length of a meeting by pausing to translate. By interpreting in real-time simultaneously, I move the closing along, allowing the notary to proceed efficiently while you are informed every second.

2. Eliminate confusion

The “Rogito” notarial act is often read aloud in its entirety by the notary. During this reading, I ensure that nuances—such as “caparra confirmatoria” (confirming deposit) vs. “acconto” (down payment)— and many other aspects are explained clearly.

3. Assure proper translation

I catch and correct any errors of verbatim translations, where the literal Italian words may not directly translate into English. For example, “positivi e negativi” do not translate into English as “positive and negative”, but rather as “income and expenses”. I regularly see these kinds of innocent errors by non-native speakers.

4. Address questions on the spot

Foreign buyers often have last-minute questions about utility transfers, taxes, or specific clauses. I facilitate this dialogue instantly, ensuring there is no “dead air” or misunderstanding that could lead to hesitation or anxiety during the signing.

5. Overcome pronunciation differences

As a native English speaker, I can both hear and understand non-native English speakers as well as communicate with you in simple natural English.

Confidence for English-speaking buyers

The psychological weight of a property investment is significant. My goal is to move you from a state of “signing and hoping” to a state of informed confidence.

By serving as your linguistic anchor on Lake Como, I ensure that:

  • Every technicality and step in the process is transparent.
  • The communication between you and the Notary is professional and clear, not confusing.
  • You leave the office not just with a set of keys, but with the certainty that your interests were protected and your questions clearly answered.
